Process ServiceS eXPLAINED

Service of process is the serving of legal papers that initiates a lawsuit (e.g. Summons & ComplaintNotice of Petition and Petition, etc.). Additional legal documents can be served after an action has commenced (e.g. Subpoena, Notice of Motion, etc.). After legal documents are served, a process server must provide proof of service, known as an Affidavit of Service, which must be signed, notarized and filed in court. The statutes governing the service of legal papers in New York State are noted in the Civil Practice Law and Rules (CPLR). If the documents are not delivered correctly, the case can be dismissed. A party to an action cannot serve his/her own legal papers.
